La Loi
fondamentale de la langue coréenne définit le coréen comme la langue officielle
de la République de Corée et vise à améliorer la qualité de la vie en utilisant
bien la langue coréenne. Le but de la Loi fondamentale de la langue coréenne,
qui comprend l'ensemble du chapitre 27, est énoncé à l'article premier.
"Article 1 (Objet) Cette loi améliore la
qualité de la vie culturelle du peuple et contribue au développement de la
culture nationale en promouvant l'usage de la langue coréenne et en promouvant
le pouvoir créatif de la population en jetant les bases du développement et de
la conservation du coréen. "
La Loi fondamentale de la langue coréenne
se divise en trois chapitres du travail du gouvernement pour la vie nationale du
peuple et est divisée en chapitres 2 à 4.
Premièrement. Planifier et
pratiquer le développement et la préservation de la langue coréenne - <Chapitre
2>
Le ministre de la Culture, du Sport et du
Tourisme établira et mettra en œuvre le «Plan de base pour le développement de
la langue coréenne» tous les cinq ans afin de développer la langue coréenne et
rédigera un rapport sur le développement et la préservation de la langue
coréenne. Je dois. En outre, le maire de l'État ou du gouvernement local ou le
gouverneur du gouverneur de la province a nommé le fonctionnaire du gouvernement

nationales et en préservant la langue locale». Les gouvernements locaux
devraient établir et mettre en œuvre les politiques nécessaires pour permettre
aux Coréens qui ont des difficultés à utiliser la langue en raison d'un handicap
mental ou physique d'utiliser la langue coréenne sans inconvénient. " L'article
14 de l'article ①, "les institutions publiques, telles que les documents
officiels en conformité avec la langue doivent être rédigés en coréen. Cependant,
dans le cas d'un décret présidentiel, il est possible d'utiliser des caractères

Avant la loi fondamentale de la langue
coréenne, il y avait les édits du roi Gojong en 1894 et la loi sur l'exclusivité

Mar, 2009., Partial Amendment] 문화체육관광부( 국어정책과), 044-203-2537 CHAPTER I GENERAL PROVISIONS Article 1 (Purpose) The purpose of this Act is to improve the quality of cultural life of citizens and contribute to the development of the national culture by promoting the use of the Korean language, establishing the foundation of the development and preservation of the Korean language and thus promoting the improvement of creative thinking. Article 2 (Basic Idea) The State and citizens shall recognize that the Korean language is the best cultural heritage and the driving force of creating culture, and aggressively seek to contribute to the development of the Korean language, thereby establishing the identity of the national culture and preserve the Korean language to ensure that the Korean language is inherited by descendants. Article 3 (Definitions) The definitions of terms used in this Act shall be as follows: 1. The term "Korean language" means Korean as the official language of the Republic of Korea; 2. The term "Hangul" means the alphabet unique to Korea used for writing the Korean language; 3. The term "language norms" means norms necessary for using the Korean language, established through deliberations by the Korean Language Council under Article 13, including the rules of Korean spelling, standard language rules, standard language pronunciation, loanword orthography and the romanization of Korean language; 4. Omitted. <Deleted by Act No. 9491, Mar. 18, 2009> 5. The term "Korean language ability" means the ability to listen, speak, read, write, etc., which is necessary for accurately expressing and understanding thoughts, feelings, etc. through the Korean language. Article 4 (Obligations of State and Local Governments)(1) The State and local governments shall actively respond to the changing language usage environment and make efforts for the development and preservation of the Korean language, including the improvement of the Korean language ability of citizens and the preservation of regional languages. (2) The State and local governments shall formulate and implement policies to ensure that citizens, who have difficulty in using a language due to physical or mental disabilities, can use the Korean language without any inconvenience. Article 5 (Relations with Other Acts) The use and dissemination of the Korean language shall be governed by this Act, unless special provisions exist in other Acts. CHAPTER II FORMULATION OF BASIC PLANS ON DEVELOPMENT OF KOREAN LANGUAGE Article 6 (Formulation of Basic Plans on Development of Korean Language)(1) The Minister of Culture, Sports and Tourism shall formulate and implement basic plans on the development of the Korean language (hereinafter referred to as "basic plans") every five years for the development and preservation of the Korean language. <Amended by Act No. 8852, Feb. 29, 2008> (2) When the Minister of Culture, Sports and Tourism intends to formulate basic plans, he/she shall undergo deliberations by the Korean Language Council under Article 13. <Amended by Act No. 8852, Feb. 29, 2008> (3) Basic plans shall include the following matters: 1. Matters concerning the basic direction and objectives of the Korean language policy; 2. Matters concerning the direction for enacting and revising language norms; 3. Matters concerning advancement of the Korean language ability of citizens and the improvement of the Korean language usage environment; 4. Matters concerning the link between policy on the Korean language and the Korean language education; 5. Matters concerning enhancement of the status of the Korean language and the preservation of the cultural heritages related to the Korean language; 6. Matters concerning the overseas dissemination of the Korean language; 7. Matters concerning the informationization of the Korean language; 8. Matters concerning the measures of language unification between South Korea and North Korea; 9. Matters concerning the removal of inconveniences in using the Korean language by citizens, who have a difficulty in using a language due to psychological or physical disabilities, and foreigners residing in Korea; 10. Matters concerning the promotion of activities in the civil sector for the development of the Korean language; 11. Other matters concerning the use, development and preservation of the Korean language. Article 7 (Formulation of Execution Plans)(1) The Minister of Culture, Sports and Tourism shall formulate and implement detailed plans (hereinafter referred to as "execution plans") for executing basic plans. (2) The Minister of Culture, Sports and Tourism may request the heads of State agencies, local governments, public institutions under the Act on the Management of Public Institutions or related institutions, from among special corporations (hereinafter referred to as "public institutions, etc") established under other Acts to provide cooperation, when necessary for the formulation and implementation of execution plans. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9491, Mar. 18, 2009> Article 8 (Reporting) The Government shall submit polices on the development and preservation of the Korean language every five years and reports on the outcomes of implementing such policies every two years to the National Assembly before the opening of the regular session of the National Assembly in the relevant year. Article 9 (Survey of Actual Status)(1) The Minister of Culture, Sports and Tourism may collect data on the Korean language ability of citizens, the 9. Matters concerning the promotion of activities in the civil sector for the development of the Korean language; 11. Article 10 (Designation of Person in Charge of Korean Language)(1) The heads of State agencies and local governments may designate persons to be in charge of the Korean language, who exercise the overall control of duties related to the development and preservation of the Korean language, from among public officials belonging to the State agencies and local governments. (2) Necessary matters for the designation and duties of persons in charge of the Korean language under paragraph (1) shall be prescribed by Presidential Decree. CHAPTER III PROMOTION OF USING KOREAN LANGUAGE AND DISSEMINATION OF KOREAN LANGUAGE Article 11 (Enactment of Language Norms) The Minister of Culture, Sports and Tourism shall enact language norms after undergoing deliberations by the Korean Language Council under Article 13 and publicly notify the details of language norms in the official gazette. <Amended by Act No. 8852, Feb. 29, 2008> Article 12 (Evaluating Influences of Language Norms)(1) The Minister of Culture, Sports and Tourism shall evaluate the influences of language norms on the use of the Korean language by citizens and the practicality and rationality of language norms, etc. and reflect such influences, etc. in policies. <Amended by Act No. 8852, Feb. 29, 2008> (2) Matters concerning the subject matters, methods and period for evaluation under paragraph (1) shall be prescribed by Presidential Decree. Article 13 (Korean Language Council)(1) The Korean Language Council (hereinafter referred to as the "Korean Language Council") shall be established under the control of the Ministry of Culture, Sports and Tourism, so as to deliberate on important matters for the development and preservation of the Korean language. <Amended by Act No. 8852, Feb. 29, 2008> (2) The Korean Language Council shall deliberate on the following matters <Amended by Act No. 8852, Feb. 29, 2008> : 1. Matters concerning the formulation of basic plans; 2. Matters on the enactment and revision of language norms; 3. Other matters submitted by the Minister of Culture, Sports and Tourism, concerning the development and preservation of the Korean language. (3) The Korean Language Council shall consist of not more than 60 members, including one chairperson and one vice chairperson. (4) The Chairperson and the vice chairperson shall be elected from among members, and the members shall be appointed by the Minister of Culture, Sports and Tourism from among persons with expert knowledge on the Korean language and linguistics or areas related thereto. <Amended by Act No. 8852, Feb. 29, 2008> (5) The subcommittee may be established under the control of the Korean Language Council, so as to deliberate on matters falling under subparagraphs of paragraph (2). (6) Necessary matters concerning the composition and operation of the Korean Language Council under paragraph (1) shall be prescribed by Presidential Decree. Article 14 (Preparation of Official Documents)(1) Official documents of public institutions, etc. shall be prepared in Hangul in accordance with language norms: Provided, That Chinese characters or other foreign alphabets may be used in brackets, in cases prescribed by Presidential Decree. <Amended by Act No. 9491, Mar. 18, 2009> (2) Other necessary matters concerning the use of Hangul in official documents prepared by public institutions, etc. shall be prescribed by Presidential Decree. <Amended by Act No. 9491, Mar. 18, 2009> Article 15 (Spreading Korean Language Culture)(1) The Minister of Culture, Sports and Tourism shall actively conduct public relations and provide education, utilizing newspapers, broadcasting, magazines, the Internet or electric signboards to ensure that the desirable Korean language culture is spread. <Amended by Act No. 8852, Feb. 29, 2008> (2) The mass media, including newspapers, broadcasting, magazines and the Internet, shall seek to contribute to citizens' appropriate use of the Korean language. Article 16 (Promotion of Korean Language Informatization)(1) The Minister of Culture, Sports and Tourism shall actively conduct various projects for the Korean language informatization to create a new culture by generating and utilizing knowledge and information through the Korean language. <Amended by Act No. 8852, Feb. 29, 2008> (2) The State shall implement necessary policies to ensure that citizens utilizing information and communications networks, including the Internet and the remote information and communications service network, can use the Korean language in a convenient manner. (3) Information and communication service providers under subparagraph 3 of Article 2 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. shall take necessary measures to make sure that citizens can use the Korean language in a convenient manner. Article 17 (Standardization of Technical Terms) The State shall disseminate technical terms by standardizing and systematizing technical terms in each area, to ensure that citizens can use such terms in an easy and convenient manner. Article 18 (Observing Language Norms in Curriculum Books) When the Minister of Education, Science and Technology compiles, examines or recognizes curriculum books under Article 29 of the Elementary and Secondary Education Act, he/she shall observe language norms and may consult with the Minister of Culture, Sports and Tourism, when necessary. <Amended by Act No. 8852, Feb. 29, 2008> Article 19 (Dissemination of Korean Language)(1) The State shall develop the curriculum and textbooks for foreigners and overseas Koreans (hereinafter referred to as "overseas Koreans") under the Act on the Immigration and Legal Status of Overseas Koreans, who intend to learn the Korean language, train experts and conduct other projects necessary for the dissemination of the Korean language. (2) The Minister of Culture, Sports and Tourism may grant qualifications to persons who intend to teach the Korean language to overseas Koreans or foreigners. <Amended by Act No. 8852, Feb. 29, 2008> (3) Necessary matters concerning the requirements for qualifications under paragraph (2) and methods of granting qualifications shall be prescribed by Presidential Decree. Article 20 (Hangul Day)(1) The Government shall designate the 9th day of October each year as the Hangul day to make the creativity and scientific nature of Hangul widely known in Korea and overseas and inspire the national fondness for Hangul, and hold commemorative events. (2) Necessary matters concerning commemorative events under paragraph (1) shall be prescribed by Presidential Decree. Article 21 (Support for Activities of Civil Organizations) The State and local governments may provide necessary support to corporations and organizations, which conduct activities for the development and dissemination of the Korean language, within budget limits. <Amended by Act No. 9003, Mar. 28, 2008> CHAPTER IV IMPROVEMENT OF KOREAN LANGUAGE ABILITY Article 22 (Policies for Improving Korean Language Ability)(1) The State and local governments shall endeavor to provide opportunities to improve citizens' Korean language ability in an equitable manner and formulate and implement polices necessary for improving the Korean language ability. (2) The consultative body between the relevant central administrative agencies may be organized and operated to efficiently promote policies under paragraph (1). (3) Necessary matters concerning the organization and operation of the consultative body shall be prescribed by Presidential Decree. Article 23 (Examination of Korean Language Ability)(1) The Minister of Culture, Sports and Tourism may examine the Korean language ability of citizens for the improvement of their Korean language ability and the creative use of language. <Amended by Act No. 8852, Feb. 29, 2008> (2) Necessary matters concerning methods, procedures, details and period of examining the Korean language ability under paragraph (1) shall be prescribed by Presidential Decree. Article 24 (Designation of Korean Language and Culture Institutes)(1) The Minister of Culture, Sports and Tourism may designate specialized institutions and organizations related to the Korean language or affiliated organizations to schools under Article 2 of the Higher Education Act, which are equipped with specialized human resources and facilities prescribed by Presidential Decree, as the Korean language and culture institutes, to enhance the Korean language ability of citizens and offer advice on the Korean language. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9003, Mar. 28, 2008> (2) The State may subsidize the part of expenses necessary for the operation of the Korean language and culture institutes designated under paragraph (1) within budget limits. <Amended by Act No. 9003, Mar. 28, 2008> (3) When a Korean language and culture institute is deemed difficult to continue to perform its functions as a Korean language and culture institute due to the lack of specialized human resources and facilities, the Minister of Culture, Sports and Tourism may revoke such designation. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9003, Mar. 28, 2008> (4) Necessary matters concerning the methods of designating the Korean language cultural institute under paragraph (1) shall be prescribed by Presidential Decree. <Amended by Act No. 9003, Mar. 28, 2008> CHAPTER V SUPPLEMENTARY PROVISIONS Article 25 (Consultations) When the heads of central administrative agencies intend to enact or revise Acts and subordinate statues which include details on the use of the Korean language, they shall consult with the Minister of Culture, Sports and Tourism in advance. <Amended by Act No. 8852, Feb. 29, 2008> Article 26 (Hearings) When the Minister of Culture, Sports and Tourism intends to revoke the designation of any Korean language and culture institute under Article 24 (3), he/she shall hold hearings. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9003, Mar. 28, 2008> Article 27 (Delegation or Entrustment of Authority)(1) The Minister of Culture, Sports and Tourism may delegate part of his/her authority under this Act to a Special Metropolitan City Mayor, Metropolitan City Mayor or Do Governor, as prescribed by Presidential Decree. <Amended by Act No. 8852, Feb. 29, 2008> (2) The Minister of Culture, Sports and Tourism may delegate or entrust some of his/her duties under this Act to the relevant institutions or organizations, as prescribed by Presidential Decree. <Amended by Act No. 8852, Feb. 29, 2008; Act No. 9003, Mar. 28, 2008> |
