NO. 59 OF 1995: PAN SOUTH AFRICAN LANGUAGE BOARD ACT, 1995.

It is hereby notified that the President has assented to the following Act which is hereby published for general information:

ACT

To provide for the recognition, implementation and furtherance of multilingualism in the Republic of South Africa; and the development of previously marginalised languages; to establish a Pan South African Language Board; and to provide for matters connected therewith.

PREAMBLE

SINCE the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993), provides for the recognition of the principle of multilingualism;

AND SINCE provision is to be made for measures designed to achieve respect, adequate protection and furtherance of the official South African languages and for the advancement of those official languages which in the past did not enjoy
full recognition, in order to promote the full and equal enjoyment of the official South African languages and respect for the other South African languages used for communication and religious purposes:

NOW THEREFORE BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Section 1

Definitions

In this Act, unless the context otherwise indicates-

(i) "acknowledged, practising language worker" means a person with extensive experience and training in interpreting or translation or terminology or lexicography or literacy teaching or language teaching;

(ii) "Board" means the Pan South African Language Board established by section 2; (vii)

(iii) "chief executive officer" means the chief executive officer of the Board appointed in terms of section 10(1); (v)

(iv) "Constitution" means the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993); (iii)

(v) "existing" means also existing prior to the commencement of the Constitution or this Act, or at any other stage; (i)

(vi) "language planner" means a person with training in the management of language policy matters at status and corpus planning level and extensive experience as language planner, and includes a language sociologist; (ix)

(vii) "language sociologist" means a person trained in the linguistic and social, political and educational aspects of the relationship between language and society; (x)

(viii) "organ of state" means an organ of state as defined in section 233(1) of the Constitution; (viii)

(ix) "prescribed" means prescribed by or under this Act; (xi)

(x) "Provincial Gazette", in relation to a province, means the official gazette of the province; (vi)

(xi) "this Act" includes the rules made and notices issued under sections 7(9), 8(8) and (11) and 9(3)(d). (iv)

LOI

Prévoyant la reconnaissance, la mise en œuvre et la promotion du multilinguisme dans la république d'Afrique du Sud; et le développement des langues autrefois marginalisées; établissant un Conseil linguistique pan-sud-africain; et prévoyant des questions reliées à la langue.

PRÉAMBULE

ÉTANT DONNÉ QUE la Constitution de la république d'Afrique du Sud de 1993 (loi n° 200 de 1993) prévoit la reconnaissance du principe du multilinguisme;

ET ÉTANT DONNÉ QU'UNE disposition doit être prévue pour des mesures conçues afin de parvenir au respect, à la protection adéquate et à la promotion des langues officielles sud-africaines ainsi que pour l'avancement de ces langues officielles qui, dans le passé, n'ont pas été pleinement reconnues, pour promouvoir une pleine et entière jouissance des langues officielles sud-africaines et le respect pour les autres langues sud-africaines employées pour la communication et à des fins religieuses.

MAINTENANT IL EST DÉCRÉTÉ par le Parlement de la république d'Afrique du Sud ce qui suit: 

Article 1er

Définitions

Dans la présente loi, à moins que le contexte ne le précise autrement:

(i) «employé reconnu comme spécialiste de la langue» désigne toute personne ayant une grande expérience et ayant reçu une formation dans l'interprétation, la traduction, la terminologie, la lexicographie, l'alphabétisation ou l'enseignement des langues;

(ii) «Conseil» désigne le Conseil linguistique pan-sud-africain prévu à l'article 2; (vii)

(iii) «président-directeur général» désigne le président-directeur général du Conseil désigné selon les dispositions de l'article 10.1; (v)

(iv) «Constitution» désigne la Constitution de la république d'Afrique du Sud de 1993 (loi no 200 de 1993); (iii)

(v) «en vigueur» désigne aussi ce qui existait antérieurement à la Constitution ou la présente loi ou toute autre étape; (i)

(vi) «spécialiste de l'aménagement linguistique» désigne toute personne ayant une formation dans la gestion des questions de politique linguistique au niveau de la planification du statut et du corpus et une grande expérience comme aménagiste linguistique et comprenant un sociolinguiste; (ix)

(vii) «sociolinguiste» désigne toute personne formée dans les domaines linguistiques et sociaux, politiques et éducatifs dans les rapports entre la langue et la société; (x)

(viii) «organisme de l'État» désigne un organisme de l'État tel qu'il est défini à l'article 233.1 de la Constitution; (viii)

(ix) «prescrit» désigne ce qui est prescrit par ou en vertu de la présente loi; (xi)

(x) «Journal provincial», par rapport à une province, désigne le journal officiel de la province; (vi)

(xi) «la présente loi» comprend les règlements inhérents et les remarques publiées en vertu des articles 7.9, 8.8 et 8.11 et 9.3 (d). (iv)

Section 2

Establishment of Board

(1) There is hereby established a board to be known as the Pan South African Language Board.

(2) The Board shall be a juristic person and shall be represented by the chairperson or deputy chairperson or any of its members designated by the Board in general or for a specific purpose.

Section 3

Objects of Board

The Board shall have the following objects:

(a) To promote respect for and ensure the implementation of the following principles referred to in section 3(9) of the Constitution:

(i) The creation of conditions for the development and for the promotion of the equal use and enjoyment of all the official South African languages;

(ii) the extension of those rights relating to language and the status of languages which at the commencement of the Constitution were restricted to certain regions;

(iii) the prevention of the use of any language for the purposes of exploitation, domination or division;

(iv) the promotion of multilingualism and the provision of translation facilities;

(v) the fostering of respect for languages spoken in the Republic other than the official languages, and the encouragement of their use in appropriate circumstances; and

(vi) the non-diminution of rights relating to language and the status of languages existing at the commencement of the Constitution;

(b) to further the development of the official South African languages;

(c) to promote respect for and the development of other languages used by communities in South Africa, and languages used for religious purposes;

(d) to promote knowledge of and respect for the other provisions of and the constitutional principles contained in the Constitution dealing directly or indirectly with language matters;

(e) to promote respect for multilingualism in general; and

(f) to promote the utilisation of South Africa's language resources.

Article 2

Établissement du Conseil

(1) Il est par la présente institué un conseil devant être connu comme le Conseil linguistique pan-sud-africain.

(2) Le Conseil doit être une personne morale et être représenté par le président, le vice-président ou l'un de ses membres désignés par le conseil général dans un but spécifique.

Article 3

Les objectifs du Conseil

Le Conseil doit poursuivre les objectifs suivants :

(a) Promouvoir le respect et assurer la mise en œuvre des principes suivants mentionnés à l'article 3.9 de la Constitution:

(i) La création de conditions pour le développement et la promotion de l'usage égal et le bénéfice de toutes les langues officielles sud-africaines;

(ii) L'extension de ces droits relatifs à la langue et le statut des langues qui, lors de l'adoption de la Constitution, ont été limités à certaines régions;

(iii) Des mesures préventives contre l'usage de toute langue à des fins d'exploitation, de domination ou de division;

(iv) La promotion du multilinguisme et des mesures prévoyant des services de traduction;

(v) L'encouragement au respect des langues parlées dans la République autres que les langues officielles et l'encouragement quant à leur usage dans des circonstances appropriées; et

(vi) La non-réduction des droits relatifs à la langue et au statut des langues en vigueur au moment de l'adoption de la Constitution;

(b) Promouvoir aussi le développement des langues officielles sud-africaines;

(c) Promouvoir le respect et le développement des autres langues employées par les communautés en Afrique du Sud ainsi que les langues employées à des fins religieuses;

(d) Promouvoir la connaissance et le respect pour les autres dispositions et les principes constitutionnels contenus dans la Constitution ayant affaire directement ou indirectement avec les questions linguistiques;

(e) Promouvoir le respect pour le multilinguisme en général; et

(f) Promouvoir l'usage des ressources linguistiques de l'Afrique du Sud.

Section 4

Independence and impartiality of Board

(1) The Board, individual members of the Board and officials of the Board shall serve impartially and independently and exercise, carry out and perform their powers, duties and functions in good faith and without fear, favour, bias or prejudice, subject only to the Constitution and this Act and accountable to Parliament.

(2) No organ of state and no member or employee of an organ of state or any other person shall interfere with the Board, any member thereof or a person appointed under section 10 in the exercise, carrying out or performance of its, his or her powers, duties and functions.

(3) All organs of state shall afford the Board such assistance as may reasonably be required for the protection of the Board's independence, impartiality, dignity and effectiveness in the exercise, carrying out and performance of the Board's powers, duties and functions.

(4) No member of the Board or member of staff of the Board shall conduct an investigation in terms of this Act or render assistance with regard thereto in respect of a matter in which he or she has any pecuniary or other interest which might preclude him or her from exercising, carrying out or performing his or her powers, duties and functions in a fair, unbiased and proper manner.

(5) If any member of the Board or any member of the staff of the Board fails to disclose an interest contemplated in subsection (4), the Board may take such steps as it deems necessary to ensure a fair, unbiased and proper investigation.

Section 5

Composition of Board

(1)(a) The Senate, after having followed the procedure prescribed in subsection (3), shall appoint the following members to the Board:

(i) Four persons who shall be acknowledged, practising language workers of whom-

(aa) one shall be an interpreter;
(bb) one shall be a translator;
(cc) one shall be either a terminologist or a lexicographer; and
(dd) one shall be either a language teacher or a literacy teacher;

(ii) three persons who shall be language planners;
(iii) five persons who shall have special knowledge of language matters in South Africa; and
(iv) one person who shall be a legal expert with special knowledge of language legislation.

(b) The chief executive officer shall be a member of the Board by virtue of his or her office and may take part in the deliberations of the Board and shall have the same rights and duties as the other members of the Board, but shall have no right to vote.

(2) The members of the Board shall-

(a) be fit and proper persons for the offices held by them;
(b) be South African citizens;
(c) be broadly representative of the diversity of the South African community; and
(d) be supportive of the principle of multilingualism.

(3) The Senate shall appoint a member in terms of subsection (1)(a) to the Board in accordance with the following procedure:

(a) (i) The Senate shall appoint an ad hoc committee, consisting of not less than nine senators, to invite nominations from the general public of persons for appointment as members to the Board.

(ii) Each province and each political party represented in the Senate shall be represented in such committee.

(iii) Each political party represented in the National Assembly may nominate one member of the National Assembly for appointment as a member to such committee.

(b) The said committee shall in a consensus-seeking manner-

(i) compile a short list of candidates with due regard to the provisions of subsections (1)(a) and (2): Provided that a short list of not more than 52 candidates shall be compiled when the Board is composed for the first time;

(ii) interview the candidates on the short list in a public and
transparent manner; and

(iii) submit a final short list to the Senate with due regard to the
provisions of subsections (1)(a) and (2): Provided that a final
short list of not more than 26 candidates shall be compiled when the Board is composed for the first time.

(c) The Senate shall appoint in terms of subsection (])(a), as a member of the Board from the short list referred to in subsection (3)(b)(iii), a person approved by the Senate by a resolution adopted by a majority of not less than 75 per cent of the members present and voting.

(4) The Senate may terminate the membership of any person appointed in terms of this section-

(a) if it is satisfied that such person no longer complies with any of the requirements of subsection (2);

(b) if such person requests the Senate in writing to terminate his or her appointment; or

(c) when such person has been absent from more than two consecutive meetings of the Board without the Board's leave.

(5) A member of the Board shall be appointed for a term of five years and shall on the expiration of such term be eligible for reappointment for one further term only.

(6) If the office of a member of the Board becomes vacant before the expiration of the period for which he or she was appointed, the Senate may, subject to subsection (1)(a), appoint another person to hold office for the unexpired portion of his or her predecessor's term of office.

(7) The Senate shall give notice in the Gazette of the appointment of a member of the Board and the date of his or her appointment and, in the case of a member appointed to fill a vacancy on the Board, the period for which he or she is appointed.

Article 4

Indépendance et impartialité de Conseil

(1) Le Conseil, les membres particuliers du Conseil et les employés du Conseil doivent servir de façon impartiale et indépendante, et exercer, effectuer et remplir leurs obligations, leur autorité et leurs fonctions en toute bonne foi et sans crainte, sans partialité ni préjugé, sous réserve seulement de la Constitution et de la présente loi, et de rendre des comptes au Parlement.

(2) Aucun organisme de l'État ni aucun membre ou employé d'un organisme de l'État, ni aucune autre personne ne s'interposera au Conseil, à l'un des ses membres ou à une personne désignée en vertu de l'article 10 dans l'exercice, la réalisation ou l'exécution de son autorité, ses devoirs et ses fonctions.

(3) Tous les organismes de l'État doivent accorder au Conseil une assistance qui peut être demandée de façon raisonnable pour la protection de l'indépendance du Conseil, son impartialité, sa dignité et son efficacité dans l'exercice, la réalisation et l'accomplissement de ses devoirs et fonctions.

(4) Aucun membre du Conseil ni aucun membre du personnel du Conseil ne doit mener une enquête en vertu de la présente loi ni prêter assistance à cet égard au sujet d'une question dans laquelle il a un intérêt pécuniaire ou autre, qui pourrait lui empêcher d'exercer, de réaliser ou de remplir ses fonctions et son autorité de façon juste et impartiale.

(5) Si un membre du Conseil ou du personnel du Conseil ne réussit pas à présenter un intérêt prévu au paragraphe 4, le Conseil peut prendre des mesures jugées nécessaires pour s'assurer d'une enquête de façon  juste et impartiale.

Article 5

Composition de Conseil

(1) (a) Le Sénat, après avoir suivi la procédure prescrite au paragraphe 3, désigne les membres suivants au Conseil :

(i) Quatre personnes qui doivent être reconnues comme pratiquant une spécialité linguistique:

(aa) l'une doit être un interprète;
(bb) l'une doit être un traducteur;
(cc) l'une doit être un terminologue ou un lexicographe; et
(dd) l'une doit être un professeur de langue ou un enseignant en alphabétisation;

(ii) Trois personnes qui doivent être des spécialistes en planification linguistique;
(iii) Cinq personnes qui doivent posséder des connaissances particulières sur les questions linguistiques en Afrique du Sud; et
(iv) Une personne qui doit être un conseiller juridique avec des connaissances particulières dans les législations linguistiques.

(b) Le président doit être un membre du Conseil en vertu de ses fonctions: il peut participer aux débats du Conseil et jouit des mêmes droits et obligations que les autres membres du Conseil, mais n'a pas le droit de vote.

(2) Les membres du Conseil doivent:

(a) être des personnes conformes et adéquates pour les fonctions qu'elles occupent;
(b) être citoyens d'Afrique du Sud;
(c) être largement représentatifs de la diversité de la communauté sud-africaine; et
(d) être favorables au principe du multilinguisme.

(3) Le Sénat nomme un membre du Conseil selon les dispositions du paragraphe 1 (a), conformément à la procédure suivante :

(a) (i) Le Sénat nomme un comité ad hoc, comprenant pas moins de neuf sénateurs, et peut susciter des candidatures auprès du grand public afin de désigner des personnes comme membres au Conseil.

(ii) Chacune des provinces et chacun des partis politiques représentés au Sénat doivent figurer dans ce comité.

(iii) Chacun des partis politiques représentés à l'Assemblée nationale peut désigner l'un de ses membres pour participer à ce comité.

(b) Ledit comité doit obtenir un consensus pour:

(i) compiler une brève liste de candidats dans le respect des dispositions des paragraphes 1 (a) et 2 : à la condition qu'une brève liste d'un maximum de 52 candidats soit compilée lors de la première composition du Conseil;

(ii) Interviewer les candidats dans la brève liste de façon publique et transparente; et

(iii) Soumettre une brève liste au Sénat dans le respect des dispositions des paragraphes 1 (a) et 2 : à la condition qu'une brève liste finale d'un maximum de 26 candidats soit compilée lors de la première composition du Conseil.

(c) Le Sénat nomme selon les dispositions du paragraphe 1 (a) comme membre du Conseil de la brève liste mentionnée au paragraphe 3 (b) (iii), une personne approuvée par le Sénat lors d'une résolution adoptée par une majorité de pas moins de 75 % des membres présents lors du vote.

(4) Le Sénat peut mettre fin à l'adhésion de toute personne désignée selon les termes du présent paragraphe:

(a) s'il est convaincu qu'une personne ne respecte plus chacune des exigences du paragraphe 2;

(b) si une personne demande au Sénat par écrit de mettre fin à sa nomination; ou

(c) si une personne a été absente durant plus de deux réunions consécutives du Conseil sans demander un congé au Conseil.

(5) Tout membre du Conseil est désigné pour un mandat d'une durée de cinq ans et doit à l'expiration de ce mandat être admissible à une reconduction pour seulement un autre mandat.

(6) Si la fonction d'un membre du Conseil devient vacante avant l'expiration de la période pour laquelle il a été nommé, le Sénat peut, sous réserve du paragraphe 1 (a), désigner une autre personne à ce poste pour la portion non expirée de son prédécesseur à cette fonction.  

(7) Le Sénat doit rendre un avis dans le Journal officiel concernant la désignation d'un membre du Conseil ainsi que la date de sa nomination et, dans le cas d'un membre nommé pour combler un poste vacant au Conseil, la période pour laquelle il est nommé.

Section 6

Chairperson and deputy chairperson

(1) The members of the Board shall at the first meeting of the Board, with the chief Justice presiding, elect one of their number to be chairperson of the Board and another one to be deputy chairperson of the Board to act as chairperson during the absence or incapacity of the chairperson.

(2) The first chairperson and the first deputy chairperson shall hold office for a term of not more than two years, after which an election shall be held annually: Provided that such chairperson and deputy chairperson shall be eligible for re-election for one further term not exceeding one year.

(3) The deputy chairperson, when acting as chairperson as contemplated in subsection (1), shall have all the powers and duties of the chairperson.

(4) The office of chairperson or deputy chairperson shall become vacant-

(a) at the expiry of the incumbent's term of office as chairperson or deputy chairperson;

(b) when the incumbent tenders his or her resignation as chairperson or deputy chairperson in writing;

(c) when the incumbent ceases to be a member of the Board;

(d) when a resolution to that effect is passed by the Board; or

(e) when the incumbent dies or is declared mentally incapacitated by a court of law.

(5) The election of a new chairperson or deputy chairperson shall, in the case of a vacancy arising as contemplated in paragraphs (a), (b), (c), (d) and (e), be conducted by the chief executive officer.

Section 7

Meetings and seat of Board

(1) The Board shall meet not less than four times a year on a quarterly basis.

(2) The seat of the Board shall be in Pretoria and meetings of the Board shall be held at the time and place determined by the Board and shall be presided over by the chairperson.

(3) The Board may establish such offices as it may consider necessary to enable it to exercise its powers, to carry out its duties and to perform its functions conferred on, imposed upon or assigned to it by the Constitution, this Act or any other law.

(4) The chairperson of the Board may at any time call a special meeting of the Board to be held at such time and place as he or she may determine, and shall, upon a request signed by not fewer than three members of the Board, call a special meeting thereof to be held within 30 days after the date of receipt of such request, at such time and place as he or she may determine.

(5) Seven members of the Board appointed in terms of section 5(1)(a) shall constitute a quorum for any meeting of the Board.

(6) The Board shall function in a manner that accommodates the consensus-seeking spirit underlying the principle of multilingualism as enshrined in the Constitution.

(7) If the Board fails to reach consensus, voting at any meeting of the Board shall take place by a show of hands, and the decision of two thirds of the members of the Board present at any duly constituted meeting thereof shall constitute a decision of the Board.

(8) No decision made by or act performed under the authority of the Board shall be invalid by reason only of an interim vacancy on the Board if such decision was made or such act was performed or authorised by a meeting of the Board convened in accordance with this section.

(9) The Board may make rules in relation to the conduct of its meetings.

Article 6

Président et vice-président

(1) Les membres du Conseil doivent, lors de la première assemblée du Conseil, sous la direction du juge en chef de la Cour suprême, élire l'un de leurs membres comme président du Conseil et un autre pour être vice-président afin d'agir comme président durant l'absence ou une incapacité du président.

(2) Le premier président et le premier vice-président sont élus pour une durée d'un maximum de deux années, après laquelle une élection doit avoir lieu chaque année: à la condition que ces président et vice-président aient droit à un réélection pour un nouveau mandat n'excédant pas une année.

(3) Le vice-président, lorsqu'il agit comme président tel qu'il est prévu au paragraphe 1, possède tous les pouvoirs et obligations du président.

(4) Le bureau de président ou du vice-président devient vacant:

(a) lors de l'expiration du mandat du titulaire en poste comme président ou vice-président;

(b) lorsque le titulaire en poste présente par écrit sa démission comme président ou vice-président;

(c) lorsque le titulaire en poste cesse d'être membre du Conseil;

(d) lorsque le Conseil adopte une résolution à cet effet; ou

(e) lorsque le titulaire en poste décède ou est déclaré mentalement handicapé par un tribunal.

(5) L'élection d'un nouveau président ou d'un vice-président doit, dans le cas d'un poste vacant découlant comme prévu aux paragraphes (a), (b), (c), (d) et (e), être dirigée par le premir dirigeant.

Article 7

Réunions et siège du Conseil

(1) Le Conseil doit se réunir au moins quatre fois par an sur une base trimestrielle.

(2) Le siège du Conseil est situé à Pretoria et les réunions du Conseil sont tenues en temps et lieu déterminés par le Conseil, et elles sont présidées par le président.

(3) Le Conseil peut établir des bureaux comme il le jugera nécessaire pour lui permettre d'exercer ses pouvoirs, remplir ses obligations et exercer ses fonctions que lui confère, imposée ou assignée par la Constitution, la présente loi ou toute autre loi.

(4) Le président du Conseil peut à tout moment demander une réunion spéciale du Conseil qui doit être prévue en temps et lieu, ou comme il peut en décider et, sur demande signée par au moins trois membres du Conseil, il peut convoquer une réunion spéciale devant être tenue dans les 30 jours après la date de réception de la requête, en temps et lieu ou comme il peut en décider.

(5) Sept membres du Conseil désignés selon les termes de l'article 5.1(a) doivent constituer un quorum pour toute réunion du Conseil.

(6) Le Conseil doit fonctionner de façon à ce qu'il recueille le consensus devant être à la base de la formule du multilinguisme tel qu'il est prévu dans la Constitution.

(7) Si le Conseil ne parvient pas à atteindre un consensus, le vote à une réunion du Conseil doit avoir lieu à main levée et la décision des deux tiers des membres présents du Conseil à chacun la réunion dûment constituée devient une décision du Conseil.

(8) Aucune décision prise par un acte exécuté sous l'autorité du Conseil ne sera invalide pour l'unique raison d'un poste intérimaire est vacant au Conseil si une telle décision a été prise ou qu'un acte a été exécuté ou autorisé par une réunion du Conseil convoquée conformément en vretu du présent article.

(9) Le Conseil peut fixer des règlements pour le fonctionnement de ses réunions.

Section 8

Powers and functions of Board

(1) The Board, in addition to any powers and functions conferred on or assigned to it by law-

(a) shall make recommendations with regard to any proposed or existing legislation, practice and policy dealing directly or indirectly with language matters at any level of government, and with regard to any proposed amendments to or the repeal or replacement of such legislation, practice and policy;

(b) may request any organ of state to supply it with information on any legislative, executive or administrative measures adopted by it relating to language policy and language practice;

(c) may advise any organ of state on the implementation of any proposed or existing legislation, policy and practice dealing directly or indirectly with language matters;

(d) may monitor the observance of any advice given in terms of paragraph (c);

(e) shall make recommendations to organs of state at all levels of government where it considers such action advisable for the adoption of measures aimed at the promotion of multilingualism within the framework of the Constitution;

(f) shall actively promote an awareness of the principle of multilingualism as a national resource by developing, administering and monitoring access, information and implementation programmes;

(g) shall actively promote the development of the previously marginalised languages by-

(i) developing, administering and monitoring access, information and implementation programmes; and

(ii) undertaking such studies for report on or relating to language development as it considers advisable in the exercise of its powers and the performance of its functions;

(h) may in respect of equitable, wide-spread language facilitation services, issue directives on and monitor-

(i) applicable standards determined by the Board for such services; and
(ii) the rendering of such services;

(i) may investigate on its own initiative or on receipt of a written
complaint, any alleged violation of a language right, language policy or language practice in terms of section 11;

(j) may, having regard to the constitutional provisions and principles dealing directly or indirectly with language matters in general, and to section 3(9) of the Constitution in particular

(i) monitor the observance of the constitutional provisions regarding the use of language;

(ii) monitor the contents and observance of any existing and new legislation, practice and policy dealing directly or indirectly with language matters at any level of government;

(iii) assist with and monitor the formulation of programmes and policies aimed at fostering the equal use of and respect for the official languages, while taking steps to ensure that communities using the languages referred to in section 3(10)(c) of the Constitution have the opportunity to use their languages in appropriate circumstances;

(iv) for purposes of this subsection, in appropriate circumstances, make funds available for such a period and subject to such conditions as the Board may from time to time determine;

(k) may establish, compile and maintain databases including, but not limited to, databases of-

(i) all legislative measures (including the provisions of the Constitution) dealing with language matters; and
(ii) every policy and practice of any institution or organ of state dealing directly or indirectly with language matters.

(2) The Board may-

(a) initiate studies and research aimed at-

(i) promoting respect for the official languages of the Republic
referred to in section 3(1) of the Constitution, and their equal use and enjoyment;

(ii) promoting respect for the languages referred to in section 3(10)(c) of the Constitution;

(iii) the development of the previously marginalised languages of South Africa;

(iv) the non-diminution of rights relating to language and the status of languages existing at the commencement of the Constitution;

(v) promoting multilingualism in South Africa;

(vi) promoting the utilisation of South Africa's language resources; and

(vii) the prevention of the use of any language for the purposes of exploitation, domination or division;

(b) advise on the co-ordination of language planning in South Africa;

(c) facilitate co-operation with language planning agencies outside South Africa; and

(d) make funds available for the purpose of this subsection for such period and subject to such conditions as the Board may from time to time determine.

(3) The Board may commission any person or body of persons or institution to conduct research and prepare publications on its behalf and may for this purpose make resources available to any such person or body of persons or institution.

(4) For the purposes of this section, the Board may provide any person or body of persons with financial or other assistance.

(5) The Board shall initiate or investigate legislation, policy and practice dealing directly or indirectly with language in general and the provisions of the Constitution dealing directly or indirectly with language at any level of government, or cause it to be investigated, and may submit recommendations thereon to any legislature or organ of state.

(6) The Board may summon any person to give evidence before it, or to produce any official document or such other information or object as may be necessary for the performance of the Board's functions.

(7) If the Board deems it necessary, it may advise the Government to provide individuals or groups who are adversely affected by gross violations of language rights with financial and other support.

(8) The Board shall in the manner prescribed by the Board by notice in the Gazette and the Provincial Gazette establish-

(a) a provincial language committee in each province to advise it on any language matter in or affecting any province or any part thereof where no such provincial committee exists or where an existing provincial language committee has jurisdiction only with respect to the official languages of a particular province: Provided that if a provincial language committee exists in a particular province, and such a committee is, in the view of the Board, sufficiently representative of the languages used in the province, that committee shall be deemed to have been established in terms of this subsection for as long as it remains so representative;

(b) a language body to advise it on any particular language, sign language or augmentative and alternative communication if no such language body exists or if an existing language body does not serve its purpose: Provided that if such a body exists, it shall be deemed to have been established in terms of this subsection.

(9) The Board may authorise any of its members to act on its behalf in any matter.

(10) The Board may-

(a) appoint one or more committees consisting of one or more of its members and such other persons as it deems fit, to advise it on the exercise and performance of the Board's powers and functions;

(b) delegate or assign to any committee such of its powers, duties and functions as it deems fit;

(c) designate a chairperson and, if it deems it necessary, a deputy chairperson for every committee; and

(d) require a report to be submitted by a committee on completion of the duties and functions assigned to it under paragraph (b).

(11) The Board may in furtherance of its objects and for the purpose of the exercise of its powers and performance of its functions-

(a) make rules and issue notices; and

(b) publish such rules and notices in the Gazette and in the Provincial Gazette.

Article 8

Pouvoirs et fonctions du Conseil

(1) Le Conseil, en plus des pouvoirs et fonctions qui lui sont conférés ou assignés conformément à la loi:

(a) doit faire des recommandations au sujet de tout projet de loi ou toute loi existante, d'une pratique ou d'une politique portant directement ou indirectement su des questions de langue quelque niveau de gouvernement que ce soit ainsi qu'à l'égard d'amendements proposés, d'une abrogation ou d'un remplacement dans une législation, une pratique ou une politique;

(b) peut demander à un organisme de l'État de lui fournir de l'information sur toute mesure législative, exécutive ou administrative adoptée relative à une pratique ou une politique linguistiques;

(c) peut conseiller tout organisme de l'État sur la mise en œuvre d'une proposition de loi ou d'une existante, d'une pratique ou d'une politique portant directement ou indirectement sur des questions linguistiques;

(d) peut surveiller l'observance d'un avis donné en vertu des dispositions du paragraphe c);

(e) doit faire des recommandations aux organismes de l'État à tous les niveaux de gouvernement là où le Conseil le juge souhaitable pour l'adoption de mesures visant la promotion du multilinguisme dans le cadre de la Constitution;

(f) doit activement promouvoir une conscience de la formule du multilinguisme comme ressource nationale en développant, administrant et surveillant l'accès, l'information et les programmes de mise en œuvre ;

(g) doit activement promouvoir le développement des langues précédemment marginalisées par:

(i) l'élaboration, l'administration et le contrôle de l'accès à l'information et aux programmes de mise en œuvre ; et
(ii) l'engagement d'entreprendre des études pour faire un rapport ou relativement au développement du langage comme il le considère souhaitable dans l'exercice de ses pouvoirs et l'accomplissement de ses fonctions;

(h) peut en ce qui a trait aux services de facilitation linguistique émettre des de directives sur les questions linguistiques:

(i) par des normes applicables et déterminées par le Conseil pour ce genre de service; et
(ii) par l'octroi de ces services;

(i) peut examiner de sa propre initiative ou sur réception d'une plainte écrite toute infraction présumée d'un droit linguistique, d'une pratique ou d'une politique linguistique selon les dispositions de l'article 11;

(j) peut, en ce qui a trait aux dispositions constitutionnelles et aux principes ayant affaire directement ou indirectement avec des questions linguistiques en général et en particulier à l'article 3.9 de la Constitution: 

(i) surveiller le respect des dispositions constitutionnelles quant à l'emploi de la langue;

(ii) surveiller le contenu et le respect de toute législation existante ou nouvelle, toute pratique et politique ayant affaire directement ou indirectement avec des questions linguistiques à quelque niveau de gouvernement que ce soit;

(iii) aider et surveiller la formulation de programmes et des politiques visant à favoriser l'usage de l'égalité et du respect des langues officielles, tout en prenant des mesures pour s'assurer que les communautés employant les langues mentionnées à l'article 3.10 (c) de la Constitution aient l'occasion d'employer leurs langues dans des circonstances appropriées;

(iv) aux fins du présent paragraphe, dans des circonstances appropriées, rendre des fonds disponibles pendant une période donnée et aux conditions que le Conseil peut en temps et lieu déterminer;

(k) peut établir, compiler et maintenir des bases de données comprenant tout en n'en étant pas limité les de données :

(i) de toutes les mesures législatives (y compris les dispositions de la Constitution) traitant des questions linguistiques; et
(ii) de chaque politique et pratique de toute institution ou tout organisme de l'État portant directement ou indirectement sur des questions linguistiques.

(2) Le Conseil peut:

(a) amorcer des études et faire des recherches destinées:

(i) à la promotion du respect pour les langues officielles de la République tel qu'il est mentionné au paragraphe 3.1 de la Constitution et de leur égalité d'usage et de bénéfice;

(ii) à la promotion du respect pour les langues mentionnées à l'article 3.10 (c) de la Constitution;

(iii) au développement des langues précédemment marginalisées de l'Afrique du Sud;

(iv) à la non-diminution des droits touchant la langue et le statut des langues existant au moment de l'application de la Constitution;

(v) à la promotion du multilinguisme en Afrique du Sud;

(vi) à la promotion de l'usage des ressources linguistiques de l'Afrique du Sud; et

(vii) à la prévention de l'emploi de toute langue à des fins d'exploitation, de domination ou de division;

(b) conseiller sur la coordination de la planification linguistique en Afrique du Sud;

(c) faciliter la coopération avec des agences de planification linguistique à l'extérieur de l'Afrique du Sud; et

(d) rendre des fonds disponibles pour les fins du présent paragraphe pendant une période donnée et aux conditions que le Conseil peut en temps et lieu déterminer. 

(3) Le Conseil peut commission toute personne, entité ou institution de faire des recherches et de préparer publications à son nom et peut à cet effet rendre des ressources disponibles à ces personnes, entités et institutions.

(4) Pour les fins du présent article, le Conseil peut fournir à toute personne ou entité de l'aide financière ou toute autre forme d'aide.

(5) Le Conseil doit amorcer ou examiner toute législation, politique et pratique portant directement ou indirectement sur la langue en général et les dispositions de la Constitution portant directement ou indirectement sur la langue à quelque niveau de gouvernement que ce soit ou qu'il propose un examen, et peut soumettre des recommandations à ce sujet à une législature ou un organisme de l'État.

(6) Le Conseil peut convoquer toute personne à témoigner devant elle ou à produire un document officiel ou toute autre information ou tout autre objet comme il peut être nécessaire pour l'accomplissement des fonctions du Conseil.

(7) Si le Conseil l'estime nécessaire, il peut aviser le gouvernement d'accorder aux individus ou groupes qui sont défavorablement affectés par les infractions grossières aux droits linguistiques un appui financier et toute autre forme de soutien.

(8) Le Conseil doit établir selon les modalités prescrites par le Conseil au moyen d'un avis dans le Journal officiel et le Journal provincial:

(a) Un comité linguistique provincial dans chaque province pour le conseiller sur toute question linguistique concernant une province ou une partie de celle-ci là où aucun comité provincial n'existe ou un comité linguistique provincial existant n'a juridiction seulement en ce qui concerne les langues officielles d'une province particulière : à la condition que, si un comité linguistique provincial existe dans une province particulière et que ce comité est, de l'avis du Conseil, suffisamment représentatif des langues employées dans la province, ce comité est réputé avoir été établi selon les dispositions du présent paragraphe aussi longtemps qu'il demeure représentatif;

(b) Un organisme linguistique pour le conseiller sur une langue particulière, signaler une langue ou une communication élargie et alternative si aucun organisme linguistique n'existe ou si un organisme existant n'atteint pas ses objectifs : à la condition que si un tel organisme existe il soit réputé avoir été établi selon les termes du présent paragraphe.

(9) Le Conseil peut autoriser chacun de ses membres à agir en son nom dans toute question.

(10) Le Conseil peut:

(a) nommer un ou plusieurs comités composés d'un ou plusieurs de ses membres et toute autre personne comme il le juge bon pour le conseiller sur l'exercice et le rendement des pouvoirs et fonctions du Conseil;

(b) déléguer ou assigner à un comité certains de ses pouvoirs, obligations et fonctions comme il le juge approprié;

(c) désigner un président et, s'il le considère nécessaire, un vice-président pour chacun des comités; et

(d) exiger qu'un rapport lui soit soumis par un comité sur l'aboutissement des obligations et fonctions assignées en vertu du paragraphe (b).

(11) Le Conseil peut pour la réalisation de ses objectifs et l'aboutissement dans l'exercice de ses pouvoirs et le rendement de ses fonctions:

(a) émettre des avis et des règlements; et

(b) publier ces règlements et avis dans le Journal officiel et le Journal provincial.

Section 9

Board's relationship with organs of state, other institutions, persons and bodies of persons

(1) The Board shall strive to promote close co-operation between itself and organs of state or any person or body of persons or any institution involved in the development of language and the promotion of language rights.

(2) The Board may consult and work closely with any person or body of persons who has special knowledge of and experience in the language problems of South Africa, or who is in any way involved in the development and promotion of the principles referred to in section 3 of the Constitution.

(3) The Board, prior to making or publishing any report, findings, point of view, advice or recommendation, shall obtain the advice of-

(a) the provincial language committee concerned established under section 8(8)(a);

(b) any organ of state in respect of a matter impacting directly or indirectly on any language, language policy or language practice followed, implemented or proposed by or in such organ of state;

(c) any language body established under section 8(8)(b); or

(d) any person, group, language body or institution involved in or having an interest in the promotion of the official South African languages by inviting submissions by means of a notice to this effect in the Gazette and the Provincial Gazette.

(4) The committee, organ of state or language body referred to in paragraphs (a), (b) and (c) shall be compelled to give the advice requested by the Board.

(5) The Board may consult with any person, body, group or institution other than those referred to in subsection (3).

Section 10

Performance of administrative work of Board

(1) The Board shall, at its first meeting or as soon as practicable thereafter, appoint a chief executive officer of the Board who-

(a) shall, in consultation with the Public Service Commission and the Minister of Finance, appoint such staff as may reasonably be necessary to assist him or her with the work incidental to the performance of the functions of the Board;

(b) shall be responsible for the management of and administrative control over the staff appointed in terms of paragraph (a), and shall for those purposes be accountable to the Board;

(c) shall, subject to the Exchequer Act, 1975 (Act No. 66 of 1975),-

(i) be charged with the responsibility of accounting for State money received or disbursed for or on behalf of the Board;

(ii) cause the necessary accounting and other related records to be kept;

(d) shall exercise the powers and carry out the duties and perform the functions which the Board from time to time confers on or assigns to him or her in order to achieve the objects of the Board, and shall for those purposes be accountable to the Board.

(2) The records referred to in subsection (1)(c)(ii) shall be audited by the Auditor-General.

(3) Expenditure in connection with matters provided for in this Act shall be paid out of money appropriated by Parliament for that purpose.

(4) The chief executive officer of the Board shall be appointed on such terms and conditions and shall receive such remuneration, allowances and other service benefits as the Board may determine in accordance with the regulations made under subsection (7).

(5) The other staff of the Board shall be appointed on such terms and conditions and shall receive such remuneration, allowances and other service benefits as the chief executive officer may determine in accordance with the regulations made under subsection (7).

(6) The Board may, in consultation with the Public Service Commission, in the exercise of its powers or the performance of its functions in terms of this Act, the Constitution or any other law, in the case of specific projects, enter into contracts for the purpose of obtaining the services of persons having technical or specialised knowledge of any matter relating to the functions of the Board and, with the concurrence of the Minister of Finance, determine the remuneration, including reimbursement for travelling, subsistence and other expenses, of such persons.

(7) The President may, after the Board has made a recommendation and after consultation with the Public Service Commission, make regulations regarding the following matters in relation to the staff of the Board:

(a) (i) The different categories of salaries and scales of salaries which shall apply to the different categories of staff;

(ii) the requirements for appointment, promotion, discharge and
disciplinary steps;

(iii) the recognition of appropriate qualifications and experience for the purposes of appointment to a specific post;

(iv) the procedure and criteria for evaluation, and the conditions or requirements for promotion;

(b) the powers, duties, conduct, discipline, hours of attendance and leave of absence, including leave gratuity, and other conditions of service;

(c) the creation of posts on the establishment of the Board;

(d) the training of staff, including financial assistance for such
training;

(e) a code of conduct to be complied with by staff;

(f) the provision of official transport;

(g) the conditions on which and the circumstances under which remuneration for overtime duty and travel, subsistence, climatic, local and other allowances may be paid;

(h) subject to section 14, the legal liability of any member of staff in respect of any act performed in terms of this Act or any other law and the legal liability emanating from the use of official transport;

(i) the circumstances under which and the conditions on and the manner in which a member of staff may be found guilty of misconduct, or to be suffering from continued ill-health, or to be incapable of carrying out his or her duties of office efficiently;

(j) the procedure for dealing with complaints and grievances of members of staff and the manner in which and time when or period wherein and person to whom documents in connection with requests and communications of such members of staff shall be submitted;

(k) the membership or conditions of membership of a particular pension fund and the contributions to and the fights, privileges and obligations of members of staff or their dependants with regard to such a pension fund;

(l) the membership or conditions of membership of a particular medical aid scheme or medical aid society and the manner in which and the conditions on which membership fees and other moneys which are payable or owing by or in respect of members of staff or their dependants to a medical aid scheme or medical aid society may be recovered from the salaries of such members of staff and paid to such medical aid scheme or medical aid society;

(m) the contribution to and the rights, privileges and obligations of members of staff or their dependants with regard to such a medical aid scheme or medical aid society;

(n) in general, any matter which is not contrary to this Act or the
Constitution and which is reasonably necessary for the regulation of the terms and conditions of service of members of staff.

(8) Any regulation under this section relating to State expenditure shall be made in consultation with the Minister of Finance.

(9) When making an appointment in terms of this section, the Board shall seek to ensure that the staff of the Board is broadly representative of the South African population.

Article 9

Relations du Conseil avec les organismes de l'État, les autres établissements, les individus et les personnes morales

(1) Le Conseil doit s'efforcer de promouvoir une coopération étroite entre lui et les organismes de l'État ou de toute autre personne, entité ou institution impliquée dans le développement d'une langue et la promotion des droits linguistiques.

(2) Le Conseil peut consulter et travailler en étroite collaboration avec toute personne ou tout organisme, qui possède une connaissance et une expérience particulières dans les problèmes linguistiques de l'Afrique du Sud, ou qui n'est en aucune manière impliqué dans le développement et la promotion des principes mentionnés à l'article 3 de la Constitution.

(3) Le Conseil, avant de faire ou de publier lui-même un rapport, des conclusions, un point de vue, des conseils ou une recommandation, doit obtenir l'avis :

(a) du comité linguistique provincial concerné tel qu'il est prévu à l'article 8.8 (a);

(b) de tout organisme de l'État au sujet d'une question influençant directement ou indirectement une langue, une politique ou une pratique linguistique poursuivie, mise en œuvre ou proposée par organisme de l'État;

(c) de tout organisme linguistique créé en vertu de l'article 8.8 (b); ou

(d) de toute personne, tout groupe, toute institution ou tout organisme linguistique impliqué ou ayant un intérêt pour la promotion des langues officielles sud-africaines en demandant des soumissions au moyen d'un avis à cet effet dans la Journal officiel et le Journal provincial.

(4) Le comité, l'organisme de l'État ou l'organisme linguistique mentionné aux paragraphes (a), (b) et (c) est dans l'obligation d'accorder l'avis demandé par le Conseil.

(5) Le Conseil peut consulter toute personne, entité, institution ou tout groupe que que ceux mentionnés au paragraphe 3.

Article 10

Exécution du travail administratif du Conseil

(1) Le Conseil doit, lors de sa première réunion ou dès que possible par la suite, nommer un président qui: 

(a) en consultation avec la Commission de la fonction publique et le ministre des Finances, nomme les membres du personnel, qui peuvent être nécessaires de façon crédible pour l'aider par un travail complémentaire dans l'accomplissement des fonctions du Conseil;

(b) est responsable de la gestion du contrôle administratif sur le personnel désigné en vertu des dispositions du paragraphe a) et doit être à cette fin responsable du Conseil;

(c) sous réserve de la Loi sur la trésorerie de 1975 (loi no 66 de 1975):

(i) est chargé de la responsabilité de la gestion des sommes reçues ou déboursées par l'État pour ou au nom du Conseil;

(ii) s'occupe de la comptabilité nécessaire et d'autres documents connexes à maintenir;

(d) exerce les pouvoirs, remplit les obligations et effectue les fonctions que le Conseil lui confère parfois ou lui assigne afin d'atteindre les objectifs du Conseil et est, à cette fin, responsable devant le Conseil.

(2) Les documents mentionnés au paragraphe 1 (c) (ii) sont vérifiés par le vérificateur général.

(3) Les dépenses dans le cadre des matières mentionnées dans la présente loi doivent être versées dans des fonds prévus par le Parlement à cette fin.

(4) Le président du Conseil est désigné d'après ces modalités et reçoit une rémunération, des allocations et d'autres prestations de service tel que le Conseil peut le déterminer, conformément aux règlements adoptés en vertu du paragraphe 7.

(5) Les autres membres du personnel du Conseil sont nommés d'après ces modalités et reçoivent une rémunération, des allocations et d'autres prestations de service tel que le président peut le déterminer, conformément aux règlements adoptés en vertu du paragraphe 7.

(6) Le Conseil peut, en consultation avec la Commission de la fonction publique, dans l'exercice de ses pouvoirs ou de ses fonctions selon les dispositions de la présente loi, de la Constitution ou de toute une autre loi, dans le cas de projets spécifiques, conclure des contrats dans le but d'obtenir des services de personnes ayant des connaissances techniques ou spécialisées sur toute question relative aux fonctions du Conseil et, avec l'accord du ministre des Finances, de déterminer la rémunération, y compris les remboursements de voyage, la subsistance et d'autres dépenses pour ces personnes.

(7) Le président peut, sur recommandation du Conseil et après une consultation auprès de la Commission de la fonction publique, adopter des règlements quant aux questions suivantes par rapport au personnel du Conseil :

(a) (i) les différentes catégories de salaires et les échelles de salaires qui sont applicables aux différentes catégories de personnel;

(ii) les conditions requises pour les nominations, les promotions, les départs et les mesures disciplinaires;

(iii) l'identification des qualifications appropriées et l'expérience à un poste spécifique aux fins de la nomination;

(iv) la procédure et les critères d'évaluation et les conditions ou exigences pour une promotion;

(b) Les pouvoirs, les obligations, la gestion, la discipline, les heures de présence et les autorisations d'absence, y compris les congés de gratification et autres conditions de service;

(c) La création de postes pour l'effectif du Conseil;

(d) La formation du personnel, y compris l'aide financière pour la formation;

(e) Un code de conduite devant être respecté par le personnel;

(f) Les mesures prévues pour le transport officiel;

(g) Les conditions et les circonstances dans lesquelles la rémunération des heures supplémentaires ainsi que les voyages, la subsistance, le facteur climatique et autres allocations peuvent être payés;

(h) Sous réserve de l'article 14, la responsabilité juridique de tout membre du personnel à l'égard de tout acte accompli selon les termes de la présente loi ou de toute autre loi et la responsabilité juridique provenant de l'utilisation du transport officiel;

(i) Les circonstances, conditions et façons dans lesquelles un membre du personnel peut être reconnu coupable de mauvaise conduite, souffrir d'une mauvaise santé continuelle ou est incapable de remplir efficacement ses obligations de service;

(j) La procédure pour traiter des plaintes et des griefs des membres du personnel et la manière ainsi que le moment ou la période avec laquelle une personne dont les documents en rapport avec les demandes et les communications de ces membres du personnel sont soumis;

(k) La composition ou les conditions d'adhésion à une caisse de retraite particulière ainsi que les contributions, combats, privilèges et obligations des membres du personnel ou leurs ayants droit à l'égard d'une telle caisse de retraire; 

(l) L'adhésion ou les conditions d'adhésion de participation à un régime particulier d'aide médicale ou d'une société humanitaire médicale et les façons et conditions pour lesquels des montants de cotisation et autres sommes d'argent sont payables ou dues aux membres du personnel ou de leurs ayants droit à un régime d'aide médicale ou à une société humanitaire médicale peuvent être récupérées dans les salaires de ces membres du personnel et versées à ce régime d'aide médicale ou à cette société humanitaire médicale;

(m) Les contributions, droits, privilèges et obligations des membres du personnel ou de leurs ayants droit à l'égard d'un tel régime d'aide médicale ou d'une société d'aide médicale;

(n) En général, toute question qui n'est pas contraire à la présente loi ou de la Constitution et qui est raisonnablement nécessaire pour le règlement des clauses et conditions de service des membres du personnel.

(8) Toute réglementation en vertu du présent article concernant les dépenses de l'État doit être faite en consultation avec le ministre des Finances.

(9) Lors d'une nomination selon les dispositions du présent article, le Conseil doit veiller à ce que le personnel du Conseil soit largement représentatif de la population sud-africaine.

Section 11

Procedure of and mediation, conciliation or negotiation by Board

(1) Any person acting on his or her own behalf or any person, body of persons or institution acting on behalf of its members or members of a language group or any organ of state may lodge with the Board a complaint concerning any alleged violation or threatened violation of a language right, language policy or language practice.

(2) The complaint shall be in writing and shall specify-

(a) the interest of the complainant in the matter;

(b)(i) the nature of the right allegedly violated or allegedly
threatened to be violated; or
(ii) the grounds on which he or she is of the opinion that an
investigation is necessary; and

(c) all relevant information known to him or her.

(3) The Board shall render the necessary assistance free of charge for the purposes of submitting a complaint and, where necessary, shall assist the complainant to comply with the requirements referred to in subsection (2).

(4) The Board shall on its own initiative or on receipt of a written
complaint investigate the alleged violation of any language right, language policy or language practice.

(5)(a) The Board shall, after an investigation of the alleged violation in terms of subsection (4), and if it is of the view that there is substance in the allegation, by mediation or conciliation or negotiation, endeavour (i) to resolve and settle any dispute; or (ii) to rectify any act or omission, arising from or constituting a contravention or infringement of legislation or alleged contravention or infringement of legislation, language policy or language practice, or a violation of or threat, or alleged violation of or threat to any language right.

(b) If any endeavour in terms of paragraph (a) fails and provided that the Board is of the view that there are good reasons to address the matter further, the Board shall assist the complainant or other persons adversely affected to secure redress by-

(i) referral of the matter, with a recommendation, to the organ of state against which the complaint was lodged;

(ii) recommending that the organ of state against which the complaint was lodged provide the complainant with financial or other assistance with a view to redressing any damage;

(iii) providing, in its sole discretion, the complainant with financial or other assistance to redress any damage; or

(iv) making arrangements for or providing the complainant with financial or other assistance to enable him or her to obtain relief from any other organ of state or a court of law.

(6) The Board shall inform the complainant of its decisions and, in a case where the Board has decided to take no action, it shall inform the complainant of the reasons for such decision.

(7) The Board shall publish its decisions in accordance with section 12(1).

Article 11

Procédure de médiation, de conciliation ou de négociation par le Conseil

(1) Toute personne agissant en son nom propre ou toute personne, tout groupe de personnes ou toute institution agissant au nom de ses membres ou les membres d'un groupe linguistique ou de tout organisme de l'État peut loger auprès du Conseil une plainte concernant une infraction présumée ou une menace d'une infraction à un droit linguistique, à une politique ou une pratique linguistique.

(2) La plainte doit être écrite et préciser:

(a) l'intérêt du plaignant en la matière;

(b) (i) la nature du droit prétendument violé ou prétendument
menacé par une infraction; ou
(ii) les raisons pour lesquelles le plaignant croit qu'une enquête soit nécessaire; et

(c) toute information appropriée connue par le plaignant.

(3) Le Conseil doit rendre l'aide nécessaire gratuitement pour les fins d'une plainte et, si nécessaire, aider le plaignant à se conformer aux exigences mentionnées au paragraphe 2.

(4) Le Conseil doit de sa propre initiative ou sur réception d'une plainte écrite enquêter sur l'infraction présumée à un droit linguistique, une politique ou une pratique linguistique.

(5) (a) Le Conseil doit, après une enquête sur l'infraction présumée selon les termes du paragraphe 4 et, s'il est d'avis qu'il paraît essentiel dans l'accusation que la médiation, la conciliation ou la négociation, s'efforcer (i) de résoudre et de régler tout différend; ou (ii) de corriger toute action ou omission, découlant ou constituant une infraction, une violation des lois, une infraction présumée, une transgression d'une loi, d'une politique linguistique ou d'une pratique linguistique, une infraction, une menace d'une infraction présumée à un droit linguistique.

(b) Si une entreprise selon les termes du paragraphe a) échoue et à la condition que le Conseil est d'avis qu'il y a de bonnes raisons d'aborder la question plus amplement, le Conseil doit aider le plaignant ou toute autre personne concernée à obtenir réparation en:

(i) transférant la question, avec recommandation, à l'organisme de l'État contre lequel la plainte a été déposée;

(ii) recommandant que l'organisme de l'État contre lequel la plainte a été déposée prévoit que le plaignant dispose d'une aide financière ou de toute autre assistance en vue de l'indemniser pour les préjudices;

(iii) fournissant, selon sa seule discrétion, au plaignant une aide financière ou toute autre aide pour le dédommager des préjudices; ou

(iv) en prenant des mesures pour fournir au plaignant une aide financière ou toute autre aide afin de lui permettre d'obtenir un allégement de la part de tout organisme de l'État ou d'un tribunal.

(6) Le Conseil informe le plaignant de ses décisions et, dans un cas où le Conseil a décidé de ne prendre aucune mesure, il informe le plaignant des raisons de sa décision.

(7) Le Conseil publie ses décisions en conformité avec l'article 12.1.

Section 12

Reports

(1)(a) The Board shall make public its reports, findings, points of view, advice or recommendations by means of publication in the Gazette on a quarterly basis or such other shorter period as the Board deems fit, and in the case of provincial language matters, also in the Provincial Gazette.

(b) The Board may, at any time, submit a report to Parliament or a provincial legislature if it deems it necessary.

(2) The Board's reports shall be taken into account by Parliament, legislatures and executive bodies at all levels of government, and by all organs of state, other institutions, persons and bodies of persons.

(3) The Board shall annually not later than the first day of June submit to-

(a) Parliament a comprehensive report on all its activities during the preceding year, up to 31 March; and

(b) a provincial legislature a comprehensive report on all its activities in respect of provincial language matters regarding that province.

Section 13

Remuneration and allowances of members of Board

A member of the Board or of any committee thereof may, from moneys appropriated by Parliament for such purpose, be paid such remuneration and allowances in respect of services performed by him or her with regard to the functions of the Board, as may be determined by the President in consultation with the Cabinet and the Minister of Finance.

Section 14

Liability of Board

(1) The State Liability Act, 1957 (Act No. 20 of 1957), shall apply mutatis mutandis in respect of the Board and any reference in the Act to the "Minister of the department concerned" shall be construed as a reference to the Board.

(2) A member of the Board shall not be personally liable in respect of anything reflected in any report, finding, point of view, advice or recommendations made or expressed in good faith and submitted to Parliament or any provincial legislature or made known in terms of this Act or the Constitution.

Article 15

Short title

This Act shall be called the Pan South African Language Board Act, 1995.

Article 12

Rapports

(1) (a) Le Conseil doit rendre publics ses rapports, conclusions, points de vue, conseils ou recommandations par voie de publication dans le Journal officiel sur une base trimestrielle ou toute autre période plus courte que le Conseil jugera bon et, dans le cas des questions linguistiques d'ordre provincial, également dans le Journal provincial.

(b) Le Conseil peut, à tout moment, soumettre un rapport au Parlement ou à une législature provinciale s'il le considère nécessaire.

(2) Les rapports du Conseil doivent être pris en compte par le Parlement, les Assemblées législatives et les organismes exécutifs à tous les niveaux de gouvernement et par tous les organismes de l'État, les autres institutions, les personnes et les groupes de personnes.

(3) Le Conseil doit annuellement, pas plus tard que le premier jour de juin, soumettre :

(a) au Parlement un rapport complet sur toutes ses activités pendant l'année précédente, jusqu'au 31 mars; et

(b) à une législature provinciale un rapport complet sur toutes ses activités à l'égard des questions linguistiques provinciales concernant une province donnée.

Article 13

Rémunération et indemnités des membres de Conseil

Un membre du Conseil ou d'un de ses comités peut, à partir de sommes d'argent prévues par le Parlement à cette fin, être payé par une rémunération et des indemnités pour des services qu'il a rendus relativement aux fonctions du Conseil, comme cela peut être déterminé par le président en consultation avec le Cabinet et le ministre des Finances.

Article 14

Responsabilité de Conseil

(1) La Loi sur la responsabilité de l'État de 1957 (loi no 20 de 1957), une fois effectués les changements nécessaires, s'applique à l'égard du Conseil et toute référence dans la loi au «ministre du Ministère concerné» est interprétée comme une référence au Conseil.

(2) Un membre du Conseil ne doit pas être personnellement responsable à l'égard de tout ce qui est inscrit dans un rapport, une conclusion, un point de vue, un avis ou des recommandations énoncés ou exprimés en toute bonne foi et suggérés au Parlement ou à une législature provinciale ou connus selon les dispositions de la présente loi ou de la Constitution.

Article 15

Titre bref

La présente loi est désignée comme la Loi sur le Conseil linguistique pan-sud-africain de 1995.
