Proposition 63, 1986
Section 1:
(a) Purpose
English is the common language of the people of the United States of
America and the State of California. This section is intended to preserve,
protect and strengthen the English language, and not to supersede any of
the rights guaranteed to the people of this Constitution.
(b) English as the Official Language of California
English is the official language of California.
(c) Enforcement
The Legislature shall enforce this section by appropriate legislation.
The Legislature and officials of the State of California shall take all
steps necessary to insure that the role of English as the common language
of the State of California is preserved and enhanced. The Legislature shall
make no law which diminishes or ignores the role of English as the common
language of the State of California.
(d) Personal Right of Action and Jurisdiction of Courts
Any person who is a resident of or doing business in the State of California
shall have standing to sue the State of California to enforce this action,
and the Courts of record of the State of California shall have jurisdiction
to hear cases brought to enforce this section. The Legislature may provide
reasonable and appropriate limitations on the time and manner of suits
brought under this section.
Section 2: Severability
If any provision of this section, or the application of any such provision
to any person or circumstance, shall be held invalid, the remainder of
this section to the extent it can be given effect shall not be affected
thereby, and to this end, the provisions of this section are severable.

Proposition 63,
1986 Section 1
(a) But
L'anglais est la langue commune des citoyens des États-Unis d'Amérique
et de l'État de la Californie. Cette disposition est destinée à préserver,
protéger et renforcer la langue anglaise et ne pas supprimer aucun des
droits garantis par la Constitution.
(b) L'anglais comme langue officielle de la Californie
L'anglais est la langue officielle de la Californie.
(c) Exécution
La Législature mettra en application cette disposition conformément à
la législation appropriée. La Législature et les fonctionnaires de l'État
de la Californie prendront toutes les mesures nécessaires pour s'assurer
que le rôle de l'anglais comme langue commune de l'État de la Californie
est préservé et accru. La Législature n'adoptera aucune loi diminuant ou
ignorant le rôle de l'anglais comme langue commune de l'État de la
Californie.
(d) Droit personnel d'action et juridiction des tribunaux
Toute personne résidant ou faisant
affaire dans l'État de la Californie aura la possibilité de poursuivre en justice l'État
de la Californie afin d'appliquer cette disposition et les tribunaux de l'État de la Californie auront la juridiction pour
entendre les causes apportées lors de la mise en vigueur de cette
disposition.
La Législature peut exiger des limites raisonnables et appropriées
sur le temps et la façon de demander un procès prévu conformément à cette
disposition.
Section 2
Indépendance des clauses
Si une disposition de cette section ou la
mise en vigueur de cette mesure envers toute personne ou pour toute circonstance
est invalidée, les autres dispositions ne seront pas affectées ni pour
cette fin, car les dispositions de cette section sont détachables. |
