Section 22.

Content licensees shall—

(a) not broadcast any material that is indecent or obscene or offensive to public morals, including abusive or insulting language, or offensive to religious beliefs of any section of the population, or likely to prejudice the safety of the Republic or public order and tranquility;

Section 60.

Compulsory translation licence

1) Where a work is expressed exclusively in words, the right to make a translation of that work and to publish it in Malawi may be subject to compulsory licensing conditions specified in this section.

2) A person who is a citizen of Malawi or has his habitual residence in Malawi may, subject to the provisions of this section, apply to the Minister for a non-exclusive licence to make a translation of a work, which is expressed exclusively in words, into any language in general use in Malawi, be it a foreign language or a local language of Malawi, and to publish or authorize the publication of the translation in copies.

4) A licence under this section shall not be granted unless the Minister is satisfied that—

(a) no translation of the work into the language in question has ever been published in copies by or under the authority of the owner of the right of translation, or that all previous editions in that language are out of print;

Section 65.

Compulsory reproduction licence for audio-visual works

1) The Minister may, upon application in writing made to him by any person and subject to the terms set out in section 63, grant a licence authorizing the person to—

(a) reproduce in audio-visual form a lawfully made audio-visual work, including any protected work incorporated in it; or

(b) translate any text incorporated in such work into any language in general use in Malawi, be it a foreign language or any other language of Malawi.

Article 60

Section 29.

Labels

1) No person shall distribute, sell, offer for sale, or hold in stock for sale, any pesticide unless it is in a container which prominently displays a clearly legible label which has been approved by the Board and is firmly attached to the container.

2) The text of the label and of any publication relating to a pesticide which is intended to be distributed or displayed with the pesticide shall be in English and in any other language or languages spoken in Malawi which the Board may require, and shall comply with such other requirements as may be prescribed.

Section 86.

Registration of charges created by companies

11) For the purposes of subsections (1) and (6) and of section 87, a certified copy is one which has endorsed thereon or annexed thereto a declaration to the effect that it is a true and complete copy of the original, made by an officer of the company or by some person interested therein otherwise than on behalf of the company. Where the original is in a language other than English the copy shall also contain an English translation similarly certified to the effect that it is an accurate translation of the original.

Keeping of accounting records by external company

1) Every external company to which section 312 applies shall cause to be kept, in the English language or many other language acceptable to the registrar, in relation exclusively to its operations in Malawi, proper accounting records with respect to—

(a) all sums of money received and expended by the company in the course and for the purposes of its operations in Malawi, and the matters in respect of which the receipt and expenditure takes place;

Section 316.

Obligation to state name, etc., of external company

1) Every external company shall—

(a) exhibit conspicuously in legible Roman characters on every place where it carries on business in Malawi the name of the company, the country of its incorporation, and, if the liability of the members is limited, the fact that it is so limited; and

(b) cause the name of the company and of the country of its incorporation, and, if the liability of the members is limited, the fact that it is so limited, to be stated in legible Roman characters at the head of all business correspondence of the company despatched in Malawi.

2) Where the name of the company is in a foreign language, the requirements of this section relating to the name of the company shall be deemed to be fulfilled by exhibiting or stating, as the case may be, in English, or a language acceptable to the registrar, a translation thereof, and stating it to be such a translation.

3) The fact that the word "limited" or its equivalent in a foreign language, forms part of the company’s name shall not be deemed to be a sufficient compliance with the obligations imposed by this section in relation to the exhibition or stating the name of the company, as the case may be, and the stating of the fact that the liability of the members is limited.

Section 322.

Control of public invitations relating to external companies

3) Any prospectus issued by reason of the provisions of subsection (1) shall in addition to complying with the provisions of section 168, and subject to any modifications made in accordance with subsection (2), also contain particulars with respect to the following—

(a) the instrument constituting or defining the constitution of the company;

(b) the law, or provisions having the force of law, by or under which the incorporation of the company was effected;

(c) an address in Malawi where copies of the foregoing, or, if the same are in a language other than English, certified translations thereof can be inspected; and

(d) the date on which and the country in which the company was incorporated.

Section 327.

Documents to be in approved language

1) Where, under any section of this Act, any document is required to be prepared, kept or registered such document shall, unless the section otherwise provides, be in the English language, or in any other language acceptable to the registrar.

2) Where the registrar accepts for registration a document all or part of which is in a language other than English, he may in his discretion require a translation in English to be annexed to it.

Section 336.

Penalty for improper use of "Incorporated" or "Limited "

A person who trades or carries on business in Malawi under any name or title of which the word "incorporated", "corporation" or any contraction or imitation thereof or any equivalent in a language other than English forms part or of which the word "limited" or any contraction or imitation thereof or any equivalent in a language other than English is the last word shall, unless duly incorporated under this Act or some other written law, whether of Malawi or elsewhere, and, where "limited" or any contraction or imitation thereof is the last word, unless duly incorporated with limited liability, be liable to a fine of ten Kwacha for every day upon which that name or title has been used.

(b) faire en sorte que le nom de la société et le pays de sa constitution, ainsi que, si la responsabilité des associés est limitée, le fait qu'elle soit limitée, soient indiqués en caractères romains lisibles en tête de toute correspondance commerciale de la société expédiée au Malawi.

2) Lorsque le nom de la société est en langue étrangère, les exigences du présent article relatives au nom de la société sont réputées satisfaites par la présentation ou la mention, selon le cas, en anglais ou dans une langue acceptable par le registraire, d'une traduction de ce nom, et la mention qu'il s'agit bien de cette traduction.

3) Le fait que le mot "limited" ou son équivalent en langue étrangère fasse partie du nom de la société ne constitue pas une conformité suffisante aux obligations imposées par le présent article concernant la présentation ou la mention du nom de la société, selon le cas, et la mention du fait que la responsabilité des associés est limitée.

Article 322

Contrôle des appels d'offres publics relatifs aux sociétés externes

3) En plus de se conformer aux dispositions de l'article 168 et sous réserve des modifications apportées conformément au paragraphe 2), toute brochure émise en raison des dispositions du paragraphe 1) doit contenir également des renseignements sur les éléments suivants:

(a) l'acte constitutif ou définissant les statuts de la société ;

(b) la loi ou les dispositions ayant force de loi, par ou en vertu desquelles la constitution de la société a été effectuée;

(c) une adresse au Malawi où des copies des documents susmentionnés ou, si ceux-ci sont rédigés dans une autre langue que l'anglais, des traductions certifiées conformes peuvent être consultées ; et

(d) la date et le pays de constitution de la société.

Documents devant être rédigés dans la langue approuvée

1) Lorsqu'un article de la présente loi exige la préparation, la conservation ou l'enregistrement d'un document, ce document doit, sauf disposition contraire de l'article, être rédigé en anglais ou dans toute autre langue acceptée par le registraire.

2) Lorsque le registraire accepte l'enregistrement d'un document rédigé en tout ou partie dans une langue autre que l'anglais, il peut, à sa discrétion, exiger qu'une traduction en anglais y soit annexée.

Sanction pour usage abusif des termes « incorporée » ou « à responsabilité limitée »

Quiconque négocie ou exploite une entreprise au Malawi sous un nom ou un titre dont les mots "incorporated", "corporation" ou toute contraction ou imitation de ces mots ou de tout équivalent dans une autre langue que l'anglais fait partie ou dont le mot "limited" ou toute contraction ou imitation de ce mot ou de tout équivalent dans une autre langue autre que l'anglais est le dernier mot, à moins qu'il ne soit dûment incorporé en vertu de la présente loi ou de toute autre loi écrite, que ce soit au Malawi ou ailleurs, et, lorsque le mot "limited" ou toute contraction ou imitation de ce terme est le dernier mot, à moins qu'il ne soit dûment incorporé à responsabilité limitée, est passible d'une amende de dix kwacha pour chaque jour où ce nom ou ce titre a été utilisé.

Section 11.

Temporary registration officers

1) The Commission may employ temporary staff, on such terms and conditions as it shall determine, as registration officers who shall register voters throughout Malawi.

2) No person shall be employed as a registration officer with respect to any ward, unless—

(a) he is an eligible voter and has attained the age of eighteen years;
(b) he has attained the minimum educational qualification of Junior Certificate of Education or its equivalent; and
(c) he has knowledge of the language commonly spoken in the ward.

Section 27.

Qualifications of councillors

1) A person shall not be qualified to be nominated or elected as a councillor unless that person—

(a) has, at the time of nomination, attained the age of twenty-one years;
(b) is able to speak and to read the English language well enough to take an active part in the proceedings of the Council; and
(c) is registered as a voter.

Section 30.

Nomination paper and supporting documents

1) Every candidate or his election representative shall at the time of his nomination deliver to the returning officer—

(a) a nomination paper completed and executed in the prescribed form;

(b) evidence, or a statutory declaration by the candidate made before a magistrate or a commissioner for oaths, that the candidate—

(i) is a citizen of Malawi and has attained the minimum age of twenty-one years; and
(ii) is able to speak and to read the English language well enough to take an active part in the proceedings of the council;

(c) evidence that he is registered as a voter.

Section 52.

Polling station officers

1) The Commission shall appoint polling station officers in its service whose duty shall be to administer the proceedings at polling stations, including more particularly the casting of votes, and to count the votes cast at polling stations.

2) The Commission shall post at every polling station at least five polling station officers one of whom the Commission shall designate as the presiding officer for that polling station and at least one of whom shall be a person able to speak the language commonly spoken in the area of the polling station.

Candidature et pièces justificatives

1) Un candidat ou son représentant électoral doit, lors de sa candidature, remettre au directeur du scrutin :

(a) une déclaration de candidature dûment remplie et signée selon les modalités prescrites ;
(b) une attestation ou une déclaration solennelle du candidat faite devant un magistrat ou un commissaire à l’assermentation, attestant que le candidat :

(i) est citoyen du Malawi et a atteint l’âge minimum de vingt et un ans; et
(ii) maîtrise suffisamment l’anglais pour participer activement aux travaux du conseil ;

(c) une attestation d’inscription sur les listes électorales.

Article 52

Responsables des bureaux de vote

1) La Commission nomme des agents de bureau de vote dont la mission est d'administrer les opérations dans les bureaux de vote, notamment le vote, et de dépouiller les suffrages exprimés.

2) La Commission poste dans chaque bureau de vote au moins cinq agents de bureau de vote, dont l'un est désigné comme président de bureau de vote et dont au moins un parle la langue couramment parlée dans la zone du bureau de vote.

Standard form contracts

1) Standard form contracts or agreements shall—

(a) be drafted in terms which are clear and understandable to a consumer and shall not contain references to contracts, rules, practices, texts or documents which, not being within public or common knowledge, are not made available to a consumer prior to the execution of the agreement or contract;

(b) be drafted in the official language and in characters readable at single sight by any normal sighted person; and

(c) where the contract is entered into locally, have a written translation into the national local language and shall be read and explained to an illiterate, blind, mute and similarly disabled consumer in a language he understands.

2) The Council [Consumer Protection Council] shall control and regulate the standard form agreements to ensure adequate consumer protection.

Section 58.

Undertaking by foster parents

2) Where the prospective foster parent cannot read the English language sufficiently to understand the nature of the undertaking, the social welfare officer concerned shall cause the undertaking to be explained to the prospective foster parent in a language which he/she understands and shall certify to that effect as prescribed in Form 2 in the Second Schedule.

Section 126.

Access by a child to legal representation

1) A child has the right to legal representation.

2) A child, parent, guardian or appropriate adult may appoint a legal representative of their choice to provide legal representation to the child.

5) A child, parent, guardian, or appropriate adult has the right to give instructions to a legal representative in the language of their choice, and, where necessary, with the assistance of an interpreter.

Section 144.

Criminal procedure in a child justice court

1) Where a child is brought before a child justice court charged with any offence it shall be the duty of the court as soon as possible to explain to the child in simple language suitable to his age and understanding the substance of the alleged offence.

2) After explaining the substance of the alleged offence, the court shall ask the child whether he admits or does not admit the facts constituting the offence.

Section 145.

Proceedings of a child justice court to be informal

The proceedings of a child justice court shall be informal and in particular, the presiding officer shall ensure that—

(a) technical language is not used during hearing;

Article 58

2) L'enfant, le parent, le tuteur ou l'adulte approprié peut désigner un représentant légal de son choix pour assurer la représentation judiciaire de l'enfant.

5) L'enfant, le parent, le tuteur ou l'adulte concerné a le droit de donner des instructions à un représentant légal dans la langue de son choix et, si nécessaire, avec l'aide d'un interprète.

Article 144

Procédure pénale devant un tribunal pour enfants

1) Lorsqu'un enfant est traduit devant un tribunal pour enfants accusé d'une infraction, le tribunal a le devoir de lui expliquer, dans les meilleurs délais, dans un langage simple et adapté à son âge et à sa compréhension, la substance de l'infraction présumée.

2) Après avoir expliqué la substance de l'infraction présumée, le tribunal demande à l'enfant s'il reconnaît ou non les faits constitutifs de l'infraction.

Procédure informelle devant un tribunal pour enfants

La procédure devant un tribunal pour enfants est informelle et, en particulier, le président veille à ce que :

a) aucun langage technique ne soit utilisé pendant l'audience ;
